Amid Chief Minister Arvind Kejriwal’s demand for early assembly elections in Delhi, experts on Sunday shared some important points on this issue. They said that the Delhi government may have to write a letter to the Election Commission and explain the reason behind this demand. However, the final decision on when the elections should be held will be taken by the Election Commission. Let us tell you that the term of the Delhi Assembly is ending on February 23 next year. In such a situation, the elections are expected to be held in early February.
It is noteworthy that Arvind Kejriwal on Sunday demanded that assembly elections in Delhi should be held in November along with Maharashtra. The term of Maharashtra assembly is ending on 26 November. Experts familiar with the constitutional provisions as well as the Representation of the People Act said that the Delhi government may have to write a letter to the Election Commission and explain the reasons for holding early elections, but the decision will have to be taken by the commission.
An expert, on the condition of anonymity, said- From a legal point of view, the Election Commission has the right to hold assembly elections in Delhi along with Maharashtra. Since on many previous occasions, assembly elections in Delhi have been held separately from other states. Still, the Election Commission should have some justification for holding assembly elections of Maharashtra and Delhi together.
Experts said that the voter list will be updated in Delhi in January. For this, January 1 will be considered as the eligibility date. Only after its update, new voters will be able to vote. In such a situation, the Election Commission may prefer to conduct elections in the national capital as per the pre-determined schedule. However, the final decision has to be taken by it.
In fact, after Kejriwal’s statement, discussions about early elections have intensified. Addressing Aam Aadmi Party workers on Sunday, Arvind Kejriwal said that I demand that along with the Maharashtra assembly elections, elections should be held in the national capital in the month of November. Kejriwal also said that he will resign after two days. After this, he will demand early elections in Delhi. Kejriwal vowed not to sit on the CM’s chair until people give him a ‘certificate of honesty’.
