Can’t an educated woman get bail? Why did SC get angry at the High Court in K Kavita case

After Manish Sisodia, now Kavita has got a big relief from the Supreme Court. The Supreme Court has rejected the order of the High Court and granted bail. In this way, Kavita, who has been lodged in Tihar Jail for the last several months, will be able to come out of jail. While granting bail to Kavita, the Supreme Court also objected to the comment of the High Court. In fact, the High Court, while refusing to grant bail to Kavita, had said that an educated and sophisticated woman is not entitled to bail benefits under PMLA.

According to the Bar and Bench report, the Supreme Court objected to this and said, if this order of the High Court is allowed to become a law, it will mean that no educated woman can get bail. This will apply to all the courts under the jurisdiction of at least Delhi. What is this? On the contrary, we say that the courts should not discriminate between MPs and common people. The court said, it cannot be said that because she is educated or an MP or MLA, she can be deprived of the benefits of the provisions of the PMLA Act.

Evidence sought from CBI-ED

Along with this, the Supreme Court on Tuesday questioned the ED and CBI as to what evidence they have to prove that K. Kavitha was involved in the alleged Delhi Excise Policy scam. A bench of Justices BR Gavai and KV Vishwanathan is hearing the petitions of the Bharat Rashtra Samiti (BRS) leader requesting bail in the corruption and money laundering cases related to this alleged scam. These cases are being investigated by the CBI and the ED.

Senior advocate Mukul Rohatgi, appearing for Kavita, had requested bail saying that the investigation by both the agencies against his client has been completed. He also cited the Supreme Court’s decision to grant bail to co-accused and Aam Aadmi Party (AAP) leader Manish Sisodia in both the cases. Additional Solicitor General SV Raju, appearing for the investigating agencies, claimed that Kavita had ‘formatted’ her mobile phone and her conduct was tampering with evidence. However, Rohatgi denied this allegation.

The Supreme Court had sought a reply from the CBI and ED on August 12 on Kavita’s bail applications in both the cases. Kavita has challenged the Delhi High Court’s July 1 order denying her bail in these cases. Let us tell you, the ED arrested Kavita from her Banjara Hills house in Hyderabad on March 15. The CBI arrested her on April 11 in a corruption case related to the alleged scam.
