Karnataka Chief Minister M. Siddaramaiah will be prosecuted in the land scam case. The Governor had given approval for this, against which Siddaramaiah had filed a petition in the High Court. The High Court has rejected Siddaramaiah’s petition and has declared the approval given by the Governor as correct. There is an allegation of scam in the allotment of plots of Mysore Urban Development Authority (MUDA), in which permission to prosecute Siddaramaiah was given by Governor Thawarchand Gehlot. Against this, Siddaramaiah had gone to the High Court.
Hearing his petition, Justice M. Nagaprasanna said that the permission to run the case was given by Governor Thawarchand Gehlot as per the rules. Activists TJ Abraham, S. Krishna and Pradeep Kumar SP had filed a complaint in this case. Justice Nagaprasanna said that usually the Governor takes a decision only on the recommendation of the Council of Ministers, but the Constitution also allows him to take independent decisions in special circumstances. The court said that it was necessary to take a decision on the complaint in this case. Usually the Governor takes decisions on the advice of the Council of Ministers, but sometimes decisions can be taken independently under special circumstances.
The court said that this case is of such an exception and special situation. The bench said that there does not seem to be any mistake in the decision of the Governor. The High Court said that along with our order, any interim order coming from the lower court will also become ineffective. Actually, the hearing of this case was also going on in the lower court on the application of Siddaramaiah. Now after the decision of the High Court, that case is over. Actually, on August 16, Governor Thawarchand Gehlot had given permission to run a case against Siddaramaiah under section 17A of the Prevention of Corruption Act.
