Custody was sought repeatedly on the same issue, arrest was illegal; HC admonished ED

Former Congress MLA and candidate from Sonipat assembly seat Surendra Pawar has got a big relief from the High Court. Punjab and Haryana High Court declared Surendra Pawar’s arrest by ED as illegal and political. Justice Mahabir Singh Sandhu’s court pronounced this order in open court. Pawar’s argument was that his arrest was made for political reasons. The legal process was not followed properly in this case. He had said that action was taken against him for political reasons in the case registered under the Money Laundering Act and there was a constant demand to keep him in custody.

On this, the court gave the verdict in favor of Surendra Pawar after hearing. The bench said, ‘Surendra Pawar was arrested for political reasons. He was one of the few people who were arrested in this case. The ED repeatedly gave the same arguments and sought custody remand. It was said that he is not cooperating as an accused. His behavior is confusing and he needs to be confronted with other people. On this, the petitioner challenged the arguments of the ED and said that no new evidence has been presented against him so far. In this case, the Special Court had earlier given remand, but later refused to extend it.

Not only this, the court said that ED did not give the correct reason for the arrest. Apart from this, the application seeking remand also did not give the correct reasons and the legal grounds were also weak. In this way, the High Court gave a big relief to Surendra Singh Panwar. Apart from this, the bench also raised questions on the order of remand by the Special Court. The bench said that legal principles were ignored in this case. In this way, while the court gave a big relief to the Congress candidate, it also gave a harsh reprimand to the ED. This order is of yesterday, but its detailed copy has come out today.
